1. Agreement to Terms

By accessing or using PulseMI ("the Service"), operated by Context Engine Ltd ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.

2. Description of Service

PulseMI is a B2B SaaS media analytics platform that helps PR agencies, corporate communications teams, and organisations track news coverage, analyse brand sentiment, and generate executive reports. The Service provides:

  • AI-powered analysis of publicly available news articles and social media posts
  • Sentiment analysis, crisis detection, and trend identification
  • Executive briefings and professional PDF report generation
  • Real-time alerts and notifications
  • Multi-tenant workspace management for agencies

3. Account Registration

To use PulseMI, you must create an account through our identity provider (Zitadel). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.

4. Acceptable Use

You agree to use PulseMI only for lawful business purposes. You may not:

  • Use the Service to stalk, harass, or harm any individual
  • Attempt to gain unauthorised access to other users' data or accounts
  • Use the Service to compile dossiers on private individuals
  • Redistribute or resell raw data obtained through the Service without authorisation
  • Use the Service in violation of any applicable laws or regulations
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse engineer, decompile, or attempt to extract source code from the Service

5. Subscriptions and Payments

PulseMI offers subscription plans billed monthly or annually. By subscribing, you agree to pay the applicable fees. Key terms:

  • Free trials last 14 days with Professional-tier features
  • Subscriptions auto-renew unless cancelled before the renewal date
  • You may cancel at any time; access continues until the end of the current billing period
  • Refunds are handled on a case-by-case basis at our discretion
  • We reserve the right to change pricing with 30 days' notice

6. Data and Content

Your Data: You retain all rights to the data you input into PulseMI (project configurations, keywords, custom reports). We process your data only to provide the Service.

Media Content: PulseMI analyses publicly available media content. We do not claim ownership of third-party content. Analysis results (sentiment scores, summaries, reports) generated by our AI are provided as part of the Service for your business use.

Data Isolation: Each organisation's data is logically isolated in our multi-tenant architecture. We do not share one customer's data with another.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable notice. We are not liable for service interruptions caused by factors beyond our control, including internet outages, third-party service failures, or force majeure events.

8. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
  • AI-generated analysis is provided for informational purposes and should not be the sole basis for business decisions

9. Intellectual Property

PulseMI, including its design, code, AI models, and documentation, is the intellectual property of Context Engine Ltd. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes.

10. Termination

We may suspend or terminate your access to the Service if you violate these terms, fail to pay applicable fees, or engage in conduct that we determine is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately, and we will delete your data in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of Kenya. Any disputes arising from these Terms shall be resolved through arbitration in Nairobi, Kenya, under the Arbitration Act of Kenya.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
